The U.S. EPA on Aug. 29 resubmitted its proposed “Set 2” Renewable Fuel Standard rulemaking to the White House Office of Management and Budget, in a move that could indicate the agency is considering a major change to its current RFS proposal.The EPA in <a href="https://ethanolproducer.com/articles/epa-releases-proposed-rule-to-set-2026-2027-rfs-rvos-make-significant-changes-to-rfs-program">June released its “Set 2” proposal</a>, a rulemaking that aims to set 2026 and 2027 RFS RVOs. The rulemaking also included several provisions that aim to fundamentally alter the RFS program, including those to boost domestic biofuel production by limiting the ability for imported fuels and feedstocks to participate in the RFS and eliminate electricity, or eRINs, from the program.&nbsp;A <a href="https://ethanolproducer.com/articles/biofuel-groups-testify-on-epas-2026-2027-rfs-proposed-rule">public hearing on the proposed rule was held in July</a> and <a href="https://ethanolproducer.com/articles/biofuel-groups-weigh-in-on-epas-rfs-proposal">a public comment period closed Aug. 8</a>. After considering all the public comments submitted regarding the RFS “Set 2” proposal and making any resulting changes, the EPA would typically submit a final rule to the OMB for interagency and White House review, marking a final step before a rulemaking is promulgated.&nbsp;According to the OMB website, the EPA has resubmitted a proposed rule to the White House rather than a final rulemaking. The OMB posting does not include any information on what the content of the newly submitted proposed rulemaking might be. However, the submittal of a second proposed rulemaking rather than a final rule could indicate the agency is weighing a substantial change to the proposal that was released for public comment earlier this summer.&nbsp;
